Terms of Service
These Terms of Service (“Terms”) govern your access to and use of NexPortal, the employee portal operated by NexLogic Telecommunications Network, Inc. (“NexLogic”, “we”, “us”, or “our”) at portal.nexlogic.ph and through our official mobile applications (the “Service”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Authorized Use Only
NexPortal is provided exclusively for authorized employees, contractors, and administrators of NexLogic and participating affiliated companies. You must use only the account credentials issued to you. You may not share your login, impersonate another user, or access data you are not permitted to view.
2. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of company policy;
- Attempt to bypass security controls, probe systems, or interfere with Service operation;
- Upload malicious code, false information, or content you do not have the right to share;
- Copy, scrape, or redistribute portal data except as permitted for your job duties;
- Use the Service after your employment or authorization has ended.
3. Workforce Features
The Service includes HR and operations features such as time logging, attendance tracking, leave requests, payroll-related workflows, job orders, tasks, reimbursements, and internal communications. Your use of these features may be subject to additional employer policies. Where a company policy conflicts with these Terms regarding employment matters, your employer’s policy controls for employees of that company.
4. Time Logging, Location, and Photos
Time logging may require camera access and location data for verification and accountability. By using time logging features, you consent to the collection and processing described in our Privacy Policy. Failure to provide required permissions or verification data may prevent use of those features.
5. Company Data and Confidentiality
Information accessible through NexPortal may include confidential business, customer, and employee data. You must handle such information in accordance with your employment agreement, company policies, and applicable law. Unauthorized disclosure may result in disciplinary action and legal consequences.
6. Intellectual Property
The Service, including its software, design, logos, and documentation, is owned by NexLogic or its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.
7. Mobile Applications
If you install NexPortal from the Apple App Store or Google Play, you also agree to the applicable store terms. Apple and Google are not parties to these Terms and are not responsible for the Service.
8. Service Availability
We strive to keep NexPortal available and accurate but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice when practicable. Maintenance, updates, and factors outside our control may cause temporary downtime.
9. Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO SUPPORT INTERNAL BUSINESS OPERATIONS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXLOGIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXLOGIC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (TYPICALLY ZERO FOR EMPLOYEE ACCESS).
11. Termination
We may suspend or terminate your access at any time if you violate these Terms, company policy, or if your authorization ends. Upon termination, your right to use the Service ceases immediately.
12. Changes
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Continued use after changes take effect constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of the Philippines, unless otherwise required by mandatory law.
